SPEED System™ Orthodontics liability and the customer’s sole remedy in the event of any claimed defect shall be limited to replacement of merchandise, or at SPEED System™ Orthodontics’ option, refund of the purchase price. SPEED System™ Orthodontics shall in no event be responsible for any incidental or consequential damages, whether foreseeable or not, caused by defects in the merchandise. Any and all implied warranties, including without limitation implied warranties of merchantability or fitness for any particular purpose or use, are waived and excluded. Written notice of claimed defect must be received by SPEED System™ Orthodontics at 298 Shepherd Avenue, Cambridge, Ontario, N3C1V1 Canada within reasonable time of discovery, not to exceed one year from date of delivery. SPEED Brackets, Convertible Tubes, Buccal Tubes, hooks and archwires are designed, manufactured and warranted for single use only. Product Return Policy: Defective Products: SPEED’s sole responsibility will be to, at its option, replace, repair or refund the purchase price of any defective product up to 12 months after purchase. The SPEED Receiving Department’s count of returned product is the official final count. Return shipping costs are at Customer’s expense and must be insured at the invoiced value of the goods being shipped back. SPEED System™ Sales Representatives are not authorized to approve or pick up merchandise being returned for credit or exchange. All credits and returns are subject to the discretion of SPEED System™ Orthodontics. Non-Defective Products: Any non-defective products may be returned for credit within thirty (30) days of purchase at the sole discretion of SPEED System. At SPEED’s option, certain products returned for credit may be subject to a restocking charge.
